Terms of Use

By this Agreement, Images of Canberra grants you a personal, non-exclusive, non-transferable, license to use and reproduce imagesofcanberra.com.au Images, for a period not exceeding one calendar year, in the following ways:

Digital media designs and content such as web sites, multimedia presentations, online publications and advertising banners. Distribution of unmodified images greater than 800x600 pixels in size is not allowed.
Print media such as brochures, magazines, books, calendars, postcards and advertisements. Some images may not be suited to advertising use, please check legal requirements before using.
As part of your business image, eg on letterhead, posters, brochures, or business cards, however images must not be incorporated into logos..
As decoration in business premises or private homes. You may print and/or enlarge photos for display, decoration or as gifts.
Advertising email marketing and newsletters (opt-in email marketing only). Images may NOT be used in the any part of unsolicited bulk email (spam) or linked from spam email.

Up to 5 uses are permitted per image before another licence must be obtained. The use can be anything allowed by this agreement and the size of the image purchased. Purchase of the largest size allows the most versatility in usage and therefore is more expensive. If you require, for example, 5 high resolution uses and 2 low (web) resolution uses it is most practical to order 1x image at the Digital - High size and 1x Digital - Web size, allowing for a total of 10 uses - 5 of which are limited to web use. Printing of multiple copies and additonal print runs for the same document counts as one use. Using an image in two different documents or designs, for example an annual report plus a newspaper advertisement, counts as two uses.

Please keep a record of usage in case a usage history is required in the future or alternatively email usage to orders@imagesofcanberra.com.au. If you are unsure of your rights under this agreement, or if you wish to use an Image in a matter not expressly permitted under this agreement, please contact Images of Canberra Support for a special license.

All other rights in the Images are expressly reserved by Images of Canberra for itself and on behalf of the respective copyright holders.

You may NOT:

Use an Image other than as specified in the license agreement above..
Use or display any Image on websites designed to make sales of print on demand products, or on sites such as Cafe Press (i.e. www.cafepress.com). Images of Canberra reserves the sole right to use the images in this manner as part of imagesofcanberra.com.au product range.
Use images to compete with imagesofcanberra.com.au. This includes, by way of displaying images in any format (including thumbnails) for download on a website or including Images in templates for sale.
Use an Image with that is in any way defamatory, immoral, unlawful or infringes upon any third party's trademark or intellectual property.
Use an Image in a way that any persom in the Image content might find objectionable or defamatory- for example pornography, tobacco ads, religious and political endorsements or otherwise unlawful or immoral content.
Resell any Image.
Share an Image with others by providing access on shared disk drives or network, or allowing access within file sharing software, unless that person is reponsible for designing or otherwise using the image for the purpose the Image was purchased for and authorised by the Purchaser. Images are resistricted for use by a single organisation, business or governmnent agency (at the lowest organisational level) and may only be shared between less than 5 people within that organisation involved in the project/s for which the Images were purchased. Sharing between agencies or organistational units within a large organisation is a violation of the license agreement.
Use the Image in any template (eg Web or Flash templage) that you plan to sell or transfer to others. This does not refer to a designer using the Image as part of a design for a client.
Use any Image as part of a trademark or patent image.
Use any Image as part of a logo.
Produce printed reproductions of any Image on canvas or paper to be sold as an art or decorative print.

Except as provided in this Agreement, you may not provide, sell or transfer to anyone the Image or the right to use the Image. In addition, the work you produce with the Image must be used for your direct employer, client, or customer, who must be the end user of your work. You agree to take all commercially responsible steps to prevent third parties from duplicating any Image.

You agree that you will not share your username and password combination with any other person.

You agree to indemnify and hold Images of Canberra harmless against any damages or liability or any kind arising from any use of the Image. Neither Images of Canberra or any of its officers or agents shall be liable for any damages, whether direct, indirect, consequential, or incidental, arising out of the use of, or the inability to use, any Image or Images.

This Agreement shall be governed by the laws of the Australian Capital Terrritory and is subject to the laws of the Australian Capital Territory. Any action regarding this Agreement or use of an Image shall be in the Australian Capital Territory.

Images of Canberra makes no representations or warranties whatsoever as to the legality or validity of any Release associated with an Image. Images of Canberra makes no representations or warranties whatsoever with respect to the use of logos, uniforms, names, trademarks, property, registered or copyrighted designs or works of art depicted in any Image.

You must satisfy yourself that all necessary rights, consents or permissions as may be required for Reproduction of any Image have been secured by you.
