Terms of Use

By this Agreement, Images of Canberra grants you a personal, non-exclusive, non-transferable, license to use and reproduce imagesofcanberra.com.au Images in the following ways:

Digital media including web sites, multimedia presentations, e-books, film and video. Print media including magazines, newspapers, books, brochures, textbooks, editorials, posters, postcards, greeting cards, CD/DVD cover art, and advertising.
In connection with your business identity on letterhead, posters, brochures, or business cards but NOT as part of a logo.
As decoration in business premises or private homes.
In coordination with opt-in email marketing. Images may NOT be used in the body of unsolicited bulk email (spam) - or linked from unsolicited bulk email.

All other rights in the Images are expressly reserved by Images of Canberra for itself and on behalf of the respective copyright holders.

You may NOT:

Use an Image other than as specified in the preceding section.
Use or display any Image on websites designed to induce sales of "print on demand" products, including postcards, mugs, t-shirts, posters and other items (this includes custom designed websites as well as sites such as Cafe Press (i.e. www.cafepress.com). Images of Canberra reserves the sole right to use the images in this manner as part of imagesofcanberra.com.au product range.
Use an Image with pornographic, defamatory, or otherwise unlawful or immoral content or in such a manner that it infringes upon any third party's trademark or intellectual property.
Use an Image in a way that places a person in the photo in a bad light or depicts them in a way that they may find offensive- this includes pornography, tobacco ads, religious and political endorsements, defamatory, or otherwise unlawful or immoral content.
Resell any Image.
Share an Image by providing access on shared disk drives or network, or allowing access within file sharing software such as LimeWire or Kazaa.
Images are resistricted for use by a single organisation, business or governmnent agency (at the lowest organisational level) and may only be shared between less than 5 people within that organisation involved in the project/s for which the Images were purchased. Sharing between agencies or organistational units within a large organisation is a violation of the license agreement.
Use images to compete with imagesofcanberra.com.au. This includes, by way of displaying images in any format (including thumbnails) for download on a website or including Images in templates for sale.
Use the Image in a website template that you plan to sell or transfer to others. This does not refer to a designer using the Image as part of a design for a client.
Use any Image as part of a trademark or patent image.
Use any Image as part of a logo.
Produce printed reproductions of any Image on canvas or paper to be sold.

"Non-transferable" as used herein means that except as provided in this EULA, you may not sell, rent, load, give, sublicense, or otherwise transfer to anyone the Image or the right to use the Image. In addition, the work you produce with the Image must be used for your direct employer, client, or customer, who must be the end user of your work. You agree to take all commercially responsible steps to prevent third parties from duplicating any Image. This may include invisibly watermarking the image and identifying that Images of Canberra owns the image on the document you intend to use the Image.

If you plan to use the Images for client work, you must keep accurate and detailed records of which clients you have used images/photos for. You may use Images of Canberra images/photos for at most five (5) clients for each image you purchase.

You agree that you will not share your username and password combination. The username and password you use to purchase an Image is to be used only by you. You may use your username and password on ONE COMPUTER in your office or home at any one time. We reserve the right to monitor accounts and institute mechanical or other means to stop users from sharing their login information.

You agree to indemnify and hold Images of Canberra harmless against any damages or liability or any kind arising from any use of the Image other than the uses expressly permitted by this Agreement. Neither Images of Canberra or any of its officers, employees, partners, licensors, or agents shall be liable for any damages, whether direct, indirect, consequential, or incidental, arising out of the use of, or the inability to use, any Image or Images.

This Agreement shall be governed by the laws of the Australian Capital Terrritory. The venue of any action respecting this Agreement, any Image, or use thereof, shall be in the Australian Capital Territory and not elsewhere.

Additional rights to Images are available. If you are unsure of your rights under this agreement, or if you wish to use an Image in a matter not expressly permitted under this agreement, please contact Images of Canberra Support for a special license.

Images of Canberra makes no representations or warranties whatsoever as to the legality or validity of any Release associated with an Image. Images of Canberra makes no representations or warranties whatsoever with respect to the use of names, trademarks, logos, uniforms, registered or copyrighted designs or works of art depicted in any Image.

You must satisfy yourself that all necessary rights, consents or permissions as may be required for Reproduction of any Image have been secured by you.
